AFFECTED CLIENTS
Property managers and apartment owners are contractually responsible for maintaining the condition of their residences. But standard property and liability policies typically excludes coverage for a critical exposure area: pollutants.
THE CHALLENGE
Insurance policies define pollutants broadly, such as “any solid, liquid, gaseous, or thermal irritant or contaminant.” In multifamily housing, the common pollution exposures include things like mold, diseases, sewage, asbestos, and illicit drug labs. Pollutants have the potential to cause all the residents to become ill. Such illnesses leave managers/owners liable for bodily injury claims—which are not covered by a general liability policy. Pollutants also can do serious damage to an apartment complex, and the cost to remove pollutants and repair the damages are generally excluded by a typical property policy.
THE CLIENT
Ernie Williams, Ltd., is a thriving business operating in Algona and north central Iowa, operating a successful group of John Deere lawn and farm implement dealerships and Harley-Davidson motorcycle dealerships. However, the company had an expensive problem to solve.
THE CHALLENGE
The company was having difficulties containing its workers’ compensation premiums and had an increasing MOD rate. “We were spending $60,000 more in MODs than we should have,” recalls company president Jim Wilcox. “We were looking to reduce where we could.” The company had developed incentive programs that rewarded employees for wearing safety gear and minimizing distractions, as well as tracking claims problems on a detailed spreadsheet. Still, between 2012 and 2015, the company recorded 18 workers comp claims with paid time off. These worked against the company’s MOD, significantly increasing the cost of its coverage.
